I do remember seeing something along those lines now you mention it and it's possible he is still on garden leave. However it's equally possible I suppose that bit was incorrect, or that the club initially placed him on garden leave when he handed in his notice but that was superseded by an agreement to allow KM to walk away without having to fulfill his notice period, or that the notice period (and therefore the garden leave) has since expired. What I don't recall seeing in the initial announcement or subsequently, is a suggestion that the club has continued to have to pay KM. |  | | |

No. It really isn't a realistic hypothesis.
Gardening leave is what you do when you sack someone, or they resign, and you dont want them around the place, so keep paying them as if they were working.
This was a fixed term contract. An agreement on it was plainly reached. It is highly unlikely that would involve payments to KM, but even if it did, it would not amount to gardening leave. | |

There are clauses in contracts preventing that, otherwise every manager would just resign to join a new club rather than them having to pay compensation.
He resigned, I very much doubt he’s on gardening leave. He won’t be paid by us anymore and will be free to do what he wants with his time. There will be a clause that says if he takes a job anywhere with a certain period we’ll be due compensation though.
My guess is he sits tight for a year and goes to Everton when Moyes calls it a day next summer. |

I'm sorry, but your first paragraph simply doesn't make sense. KM resigned (with or without giving notice). The release clause, reported as £8 million for 1 year post-resignation, continues to have effect regardless of his resignation. If the clause is activated, then KM is liable to pay the club compensation as set out in his contract of employment (although in reality the new club is likely to pay or reimburse KM as part of KM's negotiations with them). It's a straightforward contractual matter. Goodwill has nothing to do with it and the club has no reason to continue to pay him. | | | |

That is simply nonsensical.
If he resigns, he is the one in breach of contract and (technically speaking) could be sued for the additional costs incurred in replacing him. The clause, requiring compensation, would remain in place, and would still be a basis for suing him if breached. | |
